Factors courts could consider include which partner is the primary caregiver for any children, disability affecting earning capacity, savings and investments, and the length of the relationship.
 
Couples would be allowed to opt out of the rules, but only through mutual agreement. Either party could apply to the court within two years of separation for the rules to apply.
